GENERAL LIABILITY WAIVER AND RELEASE OF CLAIMS Event: Gym Wars 2026 Season Season Dates: June 2026 through the conclusion of the 2026 schedule (multiple cities — see official schedule at gymwars.mygainsapp.com/schedule) Presented by: Gains App READ CAREFULLY – THIS IS A LEGAL DOCUMENT AFFECTING YOUR RIGHTS In consideration of being permitted to participate in, attend, or be otherwise involved in any Gym Wars event during the 2026 season ("Event" or "Events"), I, the undersigned, hereby agree to the following terms on behalf of myself, my heirs, personal representatives, and assigns: 1. Assumption of Risk I understand and acknowledge that participation in any Event involves inherent risks, including but not limited to risks of physical injury, illness, death, or property damage. I voluntarily assume full responsibility for any and all risks, known or unknown, associated with my participation in or attendance at any Event during the 2026 Gym Wars season. 2. Release of Liability To the fullest extent permitted by applicable law, I hereby release and hold harmless: • Gains App and its officers, employees, volunteers, and agents; • All participating gyms, gym owners, trainers, and vendors; • The owners, operators, and governing authorities of any venue or municipality where a Gym Wars event is held; • Event sponsors, partners, and associated personnel; from any and all claims, demands, damages, liabilities, or causes of action of any kind arising out of or related to my participation in or presence at any Event, including those caused by ordinary negligence. 3. Medical Treatment I consent to receive any medical treatment deemed necessary in the event of injury, accident, or illness during any Event. I understand that I am responsible for all related medical costs. 4. Photography and Media Release I grant permission to Gains App and authorized third parties to photograph, film, or otherwise record my participation in any Event and to use such images for promotional, commercial, or any other lawful purposes without compensation or further approval. 5. Compliance with Rules I agree to follow all Event rules, regulations, and instructions from staff, security, or other officials. I understand that violation of such rules may result in removal from the Event without refund. 6. Minors If signing on behalf of a minor, I certify that I am the parent or legal guardian and have the legal authority to sign this waiver on their behalf. I accept full responsibility for the minor's participation in any Event. 7. Indemnification I agree to indemnify and hold harmless the released parties from any and all claims, including attorney's fees, arising from my (or my minor's) actions, negligence, or breach of this waiver. By participating in or attending any Gym Wars Fitness Competition, I understand and acknowledge that: • Participation in physical fitness activities, including competitions, carries inherent risks of injury, including but not limited to muscle strains, sprains, heart-related conditions, broken bones, or other serious injuries. • I am voluntarily choosing to participate or attend at my own risk, and I assume full responsibility for any injury, illness, or damage that may result from my involvement. • I hereby release and hold harmless Gains App, Gym Wars organizers, event staff, sponsors, affiliates, and venue owners from any and all liability, claims, or demands arising out of or related to participation in this event. • I understand that Gains App does not provide medical insurance and will not be held responsible for any medical treatment, injury, or loss sustained during or after the event. • I confirm that I am in good physical condition and have been cleared by a healthcare professional to engage in intense physical activity. • I understand that this waiver is binding under the laws of the state in which a given Event is held, and any legal disputes shall be resolved within that jurisdiction. By entering the event space or participating in any Gym Wars activities, I confirm that I have read and understood this waiver and agree to its terms. I HAVE READ THIS DOCUMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN FREELY AND VOLUNTARILY. I ACKNOWLEDGE THAT I AM GIVING UP LEGAL RIGHTS BY SIGNING THIS WAIVER.
